Welcome to Preserve U. By accessing or using our service at preserveu.com, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the platform.

1. The Service

Preserve U provides a platform for creating encrypted digital time capsules — messages, images, videos, audio recordings, and documents that are delivered to a recipient at a scheduled future date. Features include scheduled email delivery, client-side AES-256 encryption, Dead Man's Switch, Self-Destruct mode, and Panic Button functionality.

2. Eligibility

You must be at least 18 years old to use Preserve U. By using the service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

3. Your Account

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at support@preserveu.com if you suspect unauthorised access.
• You may not share your account or create multiple accounts to circumvent restrictions.

4. Acceptable Use

You may use Preserve U only for lawful purposes. You agree not to:

• Upload, transmit, or deliver content that is illegal, harmful, threatening, abusive, harassing, or defamatory
• Distribute malware, viruses, or other harmful code
• Use the service to facilitate fraud, identity theft, or financial crimes
• Violate any applicable local, national, or international law
• Attempt to bypass, disable, or interfere with security features of the platform
• Use automated tools to scrape, crawl, or extract data from the service
• Impersonate any person or entity

We reserve the right to terminate accounts and report illegal activity to authorities.

5. Encryption & Password Responsibility

All capsule content is encrypted client-side using a password you set. We cannot recover your password or decrypt your content.If you lose the password to a capsule, the content is permanently inaccessible. You are solely responsible for securely managing passwords and sharing them with recipients.

6. Payments & Refund Policy

• Capsule creation fees are displayed clearly before payment. All prices are inclusive of applicable taxes.
• Payments are processed securely by our authorised payment partner using industry-standard encryption.
• All payments are final and non-refundable. Once a payment is completed, it cannot be reversed, cancelled, or credited under any circumstances.
• This policy applies to all capsule types — text, audio, video, image, and document — regardless of delivery status or content.

7. Delivery & Scheduling

Preserve U makes commercially reasonable efforts to deliver capsules at the scheduled time. However, delivery may be affected by technical issues, email filtering, or force majeure events. We do not guarantee exact-minute delivery and are not liable for delays beyond our reasonable control.

Capsule recipients must maintain accessible email addresses for delivery. We are not responsible for undeliverable emails due to invalid or inactive recipient addresses.

8. Dead Man's Switch & Special Features

Special features such as the Dead Man's Switch, Self-Destruct, and Panic Button are provided on a best-effort basis. You understand and accept the operational risks associated with automated triggers. Preserve U is not liable for unintended triggering of these features due to technical errors or failure to check in on time.

9. Intellectual Property

You retain all rights to the content you create in capsules. By using Preserve U, you grant us a limited, non-exclusive, non-transferable licence to store and process your encrypted content solely for the purpose of providing the service.

The Preserve U name, logo, design, and platform code are owned by Preserve U and protected by applicable intellectual property laws. You may not reproduce, modify, or distribute them without written permission.

10. Disclaimer of Warranties

Preserve U is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure. Use of the service is at your sole risk.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Preserve U and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, business interruption, or emotional distress, arising from your use of the service — even if we have been advised of the possibility of such damages.

Our aggregate liability shall not exceed the amount paid by you for the specific capsule giving rise to the claim.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996. Courts of competent jurisdiction in India shall have exclusive jurisdiction for non-arbitrable matters.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or prominent notice on the website. Continued use after changes constitutes acceptance.
